加州夫妻产权


上周沾姐姐被宝宝突发事件刷屏,有好事者查到当事人在Pasadina 的房产,甚至查到两人房产权的vesting, 凭着Community Property with Right of Survivorship 更加确认马蓉欲谋杀亲夫的阴谋论。其人其事,和俺无关,因此也不妄加评论,但有人说把产权做成Community Property with Right of Survivorship 是很不正常的,那就是无知了。


在加州,最常见的夫妻 vest 房产权的方式是Joint Tenancy,也即Joint Tenancy (with Right of Survivorship). Under Joint Tenancy, 夫妻中有一方过世后,另一方自动得到全部产权,不需要法庭的probate (Court probate是个费钱费时的process。 费用typically是房子价值的5%, 时间上也得几个月。在房产市场上,偶尔我会看到注明需要probate的房子)。Community Property with Right of Survivorship是个相对新的hold title的选择,在加州是在2001年七月一日以后才有的。两者的区别是:

1. Joint Tenancy任何两个或多个人都可以hold, Community Property或Community Property with Right of Survivorship只有夫妻或者registered domestic partners可以hold。

2. In Joint tenancy, 你可以在生前未经配偶许可, 把你的那部分产权转给其他人,一旦转给别人, 产权就不是Joint tenancy 了,新人和原来一方就变成了 Tenancy in Common; 而Community Property或Community Property with Right of Survivorship 房地产的产权转让, 包括一年以上的出租合同都必需要双方签字, 没有配偶的许可, 任何一方都不可以把它gift给第三方。

3. A judgement against one joint tenant does not serve the joint tenancy, but levying execution against the property and having a sale to end the joint tenancy. If the joint tenant dies prior to the execution of the judgement against the property, the property will pass free and clear of the debt to the surviving joint tenant(s). While community property is liable for the debts of the either spouse after marriage. The earnings of a spouse are not liable for the debts of the other spouse incurred prior to marriage. 这一段来自房地产法律定义。应该看得明白吧。

4. 刚开始Community Property with Right of Survivorship 较之Joint Tenancy 在一方过世时,有一些税收方面的优惠,但目前税收的区别已经被 Revenue Ruling 87-98 消除, Revenue Ruling 87-98 allows both joint tenancy and community property to acquire a new cost basis upon the death of a spouse if the property was acknowledged as community property before the death of the spouse)

Joint Tenancy 和Community Property with Right of Survivorship 的共同点:
都不能立遗嘱把其中一方的interest转给其他人,包括子女。如果想转给子女,就需要把产权更改成Community Property或 Tenancy in Common。

所以产权Community Property with Right of Survivorship 不稀奇,至于那么捣浆糊吗?
